1. Acceptance of Terms
1.1 These Terms and Conditions (“Agreement”) govern the contractual relationship between:

Sunset Residence, Jumeirah, Dubai, UAE
(“Anastasiia” or “Artist”)
and the Client (“Client”).
1.2 The Artist is represented by a management team (“Management”), authorized to communicate, negotiate, issue offers, and collect payments on behalf of the Artist.
2. Scope of Services
2.1 The Artist provides commissioned artwork on both movable and immovable objects owned by the Client, including but not limited to vehicles, luggage, headphones, walls, counters, and other surfaces.
2.2 The Artist may also offer self-selected and hand-painted objects for sale.
2.3 The Artist is further available for bookings including live performances, moderation, and artistic shows with additional team members.
2.4 Unless otherwise agreed in writing, these Terms and Conditions apply to all services rendered.
3.1 The Client submits an inquiry describing the object to be painted or created.
3.2 Management will contact the Client and prepare a formal offer including:
• Description of services
• Estimated timeline for sketch creation
• Estimated timeline for final execution
• Total duration including breaks
• Artist fee (including all material costs)
• Any additional costs (e.g., travel or transport)
• A 15% Booking and Artist Management fee calculated on the Artist’s net fee
3.3 The offer shall expressly reference these Terms and Conditions.
3.4 A binding contract is formed when the Client signs the contract and accepts the offer in writing.
4. Payment Terms
4.1 A 15% Booking and Artist Management fee will be charged on the Artist’s net fee, payable directly to Management.
4.2 Upon signing the contract, the Client will receive an invoice for the Booking and Artist Management fee. Payment is due within seven (7) calendar days.
4.3 After the contract is finalized, the Client will receive a separate invoice for the Artist fee, also due within seven (7) calendar days.
4.4 All services are payable in full advance (100% prepayment).
4.5 If the scheduled commencement date is less than seven (7) days from invoice issuance, the payment deadline will be shortened accordingly. Payment must be received in full before any work begins.
4.6 Failure to make timely payment may result in postponement or cancellation of the services.
5.1 The Artist retains all intellectual property rights in and to the artwork.
5.2 The Client does not obtain any rights of reproduction, duplication, or commercial exploitation of the artwork separate from the physical object.
5.3 The Client is permitted to:
• Photograph or film the the object containing the artwork
• Use such images privately or commercially
• Sell the physical object
5.4 The Client is not permitted to:
• Reproduce the artwork in isolation (digitally extracted, scanned, cropped)
• Offer the artwork as stock material
• Print the artwork or parts thereof on merchandise
• Commercially exploit the artwork separately from the object
5.5 Any use of the artwork separate from the object requires explicit written permission and a licensing agreement from the Artist.
6.1 Prior to execution, the Client will be presented with a sketch indicating the general direction, theme, and style of the planned artwork.
6.2 The sketch does not represent a final version of the artwork and is not binding.
6.3 The final result may deviate significantly from the sketch and does not constitute a defect.
6.4 The Artist reserves full artistic freedom in the creation process.
7. Execution of Work
7.1 Depending on the nature of the object, the work may be carried out at the Artist’s premises or at the Client’s location.
7.2 The Client shall provide safe, clean, and accessible working conditions.
7.3 The offer will specify:
• Time required to create the sketch
• Time required to execute the artwork
• Total duration including breaks
7.4 An additional flexible period of up to fourteen (14) days may be added to account for creative breaks, illness, or unforeseen events.
7.5 Delays caused by the Client shall extend timelines accordingly.
8.1 Upon full payment, the Client shall receive a signed Certificate of Authenticity confirming originality and authorship.
8.2 The Certificate does not transfer intellectual property or commercial rights.
8.3 The Certificate applies solely to the physical object bearing the artwork.
9.1 The Client retains ownership of the object.
9.2 The Artist is not liable for pre-existing damage or defects.
9.3 The Client assumes risk for transport or shipping unless otherwise agreed in writing.
10. Liability
10.1 The Artist is liable only for damage caused by gross negligence or intentional misconduct.
10.2 The Artist is not liable for indirect, consequential, or economic losses.
10.3 No liability is assumed for damage caused by external influences including but not limited to weather, UV exposure, abrasion, or improper care.
11.1 The Client may cancel the contract; however, all payments already made are non-refundable.
11.2 If cancellation occurs after work has commenced, the Client remains liable for 100% of the agreed fee.
11.3 The Artist may withdraw from the contract if:
• The Client fails to make timely payment
• Health, safety, or technical concerns prevent performance
12. Data Protection
12.1 Client data will be used solely for contract fulfillment and communication.
12.2 Data will not be shared with third parties unless legally required or necessary for service delivery.
13.1 The Artist is entitled to photograph and document the completed artwork and the object.
13.2 The Artist may use such imagery for portfolio purposes, including website, social media, exhibitions, and promotional materials.
13.3 The Client may be named as a reference unless otherwise agreed in writing. No address information or imagery that would reveal precise location details will be published.
13.4 If the Client does not wish to be referenced or have imagery used, this must be agreed explicitly in writing.
13.5 In absence of such written limitation, permission shall be deemed granted.
14.1 Amendments or modifications to this Agreement must be made in writing.
14.2 If any provision is deemed invalid, the remainder of the Agreement remains in effect.
14.3 This Agreement is governed by the laws of the United Arab Emirates.
14.4 Jurisdiction, where permissible, shall be Dubai, UAE.
